We provide enterprise-grade infrastructure services, including but not limited to:
 
  • Bandwidth provisioning and connectivity solutions
  • Datacentre hosting, colocation, and managed services
  • Private network design, deployment, and maintenance
  • Enterprise security monitoring and compliance services
 
We will use reasonable efforts to deliver the Services as described in your service agreement. However, you acknowledge that network performance, uptime, and availability may be affected by factors beyond our control, including third-party providers, natural disasters, or force majeure events.
 

 

3. User Responsibilities

 
You agree to:
 
  • Provide accurate and complete information when registering for or using our Services
  • Maintain the confidentiality of your account credentials and take full responsibility for all activities under your account
  • Use the Services only for lawful purposes and in compliance with all applicable laws and regulations
  • Not use the Services to transmit malicious software, spam, or engage in any activity that disrupts our network or the Services of other users
  • Comply with all usage policies, security requirements, and service level agreements provided by us
 

 

4. Payment Terms

 
All fees for the Services are specified in your service agreement or pricing schedule. Unless otherwise stated:
 
  • Fees are due in advance on a monthly, quarterly, or annual basis
  • Late payments may result in service suspension or termination
  • We reserve the right to adjust fees with prior written notice, in accordance with your service agreement
  • You are responsible for all applicable taxes, duties, or regulatory fees related to the Services
 

 

5. Intellectual Property Rights

 
All content on our website, including text, logos, graphics, and software, is the property of ETCLOUDS LIMITED or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, modify, or use any of our intellectual property without our prior written consent.
 
You retain ownership of your data and content stored on our infrastructure. We may use your data only as necessary to provide the Services, in accordance with our Privacy Policy.
 

 

6. Service Level & Uptime

 
We strive to provide reliable, high-availability Services. Specific uptime guarantees, service level objectives, and remedies for service disruptions are outlined in your individual service level agreement (SLA). We do not warrant that the Services will be error-free or uninterrupted, and we reserve the right to perform scheduled maintenance that may cause temporary outages.
 

 

7. Limitation of Liability

 
To the fullest extent permitted by law:
 
  • We shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Services, including loss of profits, data, or business interruption
  • Our total aggregate liability to you for any claim related to the Services shall not exceed the total amount paid by you to us in the 12 months prior to the claim
  • This limitation does not apply to liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded by law
 

 

8. Termination

 
Either party may terminate these Terms or your service agreement with written notice if the other party materially breaches these Terms and fails to cure the breach within 30 days of receiving written notice. We may also suspend or terminate your access to the Services immediately if:
 
  • We believe you have violated these Terms or applicable laws
  • We are required to do so by law or government order
  • You fail to pay fees when due
 
Upon termination, you must cease using the Services, and we may delete your data in accordance with our data retention policies.
 

 

9. Confidentiality

 
Both parties agree to keep confidential any non-public information shared in connection with the Services, including business plans, technical specifications, and pricing. This obligation survives the termination of these Terms for a period of 3 years.
 

 

10. Governing Law & Dispute Resolution
